When you file Chapter 11, don’t let your lawyer tell you that you need to sell or refinance your business or your property to successfully emerge from Chapter 11!

When I ask a future client what their attorney told them they should do to win the Chapter 11 fight, I am often told that their lawyer said to refinance the property/business or sell it outright.

Let’s stop and think about this for a minute:  You wouldn’t have filed Chapter 11 if refinancing was a viable option for you at that time and if you wanted to sell or could have sold at a decent price you wouldn’t have filed Chapter 11 either.

Let’s be real clear.  There is a reason the bankruptcy law is called Chapter 11 Reorganization and not Chapter 11 Sale or Chapter 11 Refinance:  The law is designed to allow you to restructure your existing loans in-place without the need to replace the loans through refinancing or to repay the loans through selling.

Indeed, the bankruptcy code, if properly utilized, enables you to restructure those loans without the approval of the bank, so why in the world wouldn’t you maximize your leverage over the bank and force them to deal?   That’s what we do. Maximize your leverage and win.

And by the way, we have specialty chapter 11 financing often through banks at bank interest rates so we can do what others can’t and have financing others don’t.
